Terms of Service

1. Acceptance of Terms

By accessing or using Identix ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Ondřej Opršal.

2. Description of Service

Identix is a SaaS platform that allows users to create, customize, and publish interactive portfolios, personal CVs, and company profiles. The Service includes AI-powered features such as cover letter generation and content translation.

3. User Accounts

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your account credentials
  • Notify me immediately of any unauthorized access or security breach
  • Accept full responsibility for all activities that occur under your account
  • Be at least 16 years of age or have parental consent to use the Service

4. User Responsibilities

Acceptable Use

You agree not to use the Service to:

  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, or defamatory
  • Impersonate any person or entity or misrepresent your affiliation
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Use the Service for any illegal or unauthorized purpose
  • Harvest or collect email addresses or other contact information of other users

5. Content Ownership

You retain all ownership rights to the content you create and upload to the Service ("Your Content"). By uploading Your Content, you grant me a limited, non-exclusive license to use, store, and display Your Content solely for the purpose of operating and providing the Service to you.

You represent and warrant that Your Content does not violate the rights of any third party, including copyright, trademark, privacy, or other personal or proprietary rights.

6. User-Generated Content Liability & Notice and Takedown

Your Responsibility

You retain full legal responsibility and liability for all content you upload, create, publish, or distribute through the Service, including but not limited to text, images, photographs, logos, trademarks, and any other materials ("Your Content"). You represent and warrant that Your Content does not infringe upon the intellectual property rights, privacy rights, or any other legal rights of any third party, and that it complies with all applicable laws and regulations.

Notice and Takedown

I reserve the right, but am not obligated, to monitor, review, or remove any content uploaded to the Service at any time and for any reason, including content that I believe, in my sole discretion, violates these Terms, infringes third-party rights, or is otherwise objectionable.

I reserve the right to suspend or terminate your account immediately and without prior notice if Your Content violates applicable laws, infringes upon third-party copyrights, trademarks, or other intellectual property rights, or breaches my Acceptable Use policies. I expressly disclaim any liability for Your Content and any loss or damage resulting from its use or display.

7. Account Termination

Suspension and Termination

I reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct that I determine to be harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease.

You may also delete your account at any time through your dashboard settings. Upon deletion, all Your Content will be permanently removed from my systems.

8. Intellectual Property

All content, features, and functionality of the Service (excluding Your Content) are and will remain the exclusive property of Ondřej Opršal and his licensors. The Service is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without my express written permission.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. I DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

Liability Cap

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONDŘEJ OPRŠAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

My total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid me, if any, in the twelve (12) months preceding the event giving rise to liability.

11. Digital Goods Refund Waiver (EU Consumer Rights)

Immediate Access to Digital Content

Identix offers digital products and services, including but not limited to PRO version subscriptions, premium features, and other digital enhancements. By purchasing any PRO version, premium subscription, or paid digital feature, you explicitly agree and consent to receive immediate access to the digital content upon completion of your purchase.

Waiver of Withdrawal Right

By consenting to immediate access to the digital content at the point of purchase, you expressly acknowledge and agree that you forfeit your statutory 14-day right of withdrawal (refund right) under applicable EU consumer protection laws, including but not limited to Directive 2011/83/EU on consumer rights. You understand that due to the nature of digital content, once access is granted, the performance of the contract has begun with your prior express consent, and you lose your right to cancel the contract and receive a refund.

This waiver does not affect any statutory rights you may have regarding defective or misdescribed digital content, nor does it affect my obligations under applicable consumer protection law.

12. Indemnification

You agree to indemnify and hold harmless Ondřej Opršal and his agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with Your Content, your use of the Service, or your violation of these Terms.

13. Changes to Terms

I reserve the right to modify these Terms at any time. I will notify you of material changes by posting the updated Terms on the Service or by email. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of the Czech Republic.
